Bad news for me

While transporting my car to Coupe King the dealers flat bed truck smashed the front of the car. Erik extimates about $3000 to fix it right. I was wondering if anyone was familiar with California laws as to what recourse I have. They already brought the paper work to the DMV but I havnt officially taken delivery.If I wanted to cancelo the sale would I be allowed or am I forced to take the carbut hold them responsible for repairs. Any help would be appreciated.
 
how awful ... so sorry to hear that. i'm sure somebody in this gruppe knows their way around california law.

Why wouldn't the transporter of the vehicle be responsible for damages incurred under his watch? Does Cormier own the flat bed transporter? Did you sign anything holding them harmless during their possesion? They have insurance for situations just like this.

I hope you get a satisfactory resolution. I have seen some comments here with a legal tone, that leads me to believe you will have some guidance (or suggestions)...mr malibu???

When I used a covered transport within California, they had insurance to cover all types
 
Cormier has been very nice about it. They are going to pay Coupe King for all the repairs. I am now just negotiating compensation for the cost of the car. I am pretty sure we will work it out. The big expense is the grill parts and the bumper. The sheet metal has had some damage between the kidneys and the lower valence.CK promises it will be as good as new. They have also been great. The depressing thing is that now it will take almost a month to get the car. :cry:
 
$3,000 in damage is probably most the parts cost...

Erik and Peter at Coupe King definitely are great and if the estimate is only $3,000 which includes a bumper, grilles etc. then probably the lions share of the estimate is for the new parts...

That being said a car that has been damaged and repaired aint the same as a car that has never been damaged!!

Also if you took a car to Cormier and wanted to trade it in they would carefully inspect every inch of the car with their Electronic Paint Gage Tool... If they found a panel that had been repainted they would use this to depreciate the value of the car and would offer you less money!... Even if you said it was only a tiny $150 door ding that you had repaired and you had the estimate to prove it they would insist that the car had been damaged and is worth less...

Trust me been there done that with dealers!!!

So if they can depreciate a car they are buying because of prior damage why cant you? Also in addition to them being liable for the damage they should also be liable for the loss of use for the 30 days...

Thank you, this is exactly what I told them. When I mentioned this they offered me $500. KInd of a joke. I told them I thought $2000 would be fair. Waiting to hear back from the owner.
 
Gentlemen, this is an E9.
A 40 year old car.
Very very few E9s are around that have never been at least partially painted, welded, repaired in some way. And those that haven´t are more often than not are really bad (hidden-)rustbuckets.
I can´t remember ever having seen a really great condition E9 that has never in any way been repaired / restored / painted.
I believe this price reduction business for minor repairs is appropriate for brand new, high value cars and even then I consider it somewhat excessive

Actually where I live, insurance and legal opinion is that when an older car is involved in an accident and gets bodywork and paint repairs, there actually is a hike in value as a well done repair will probably leave the section in a better state than before.

As for this particular damage visible in these pictures, I believe if a reputable shop such as coupeking fixes it, it´ll actually be in better shape than before, even if it looked great before. We all know bumpers that look great from outside but have quite some rust inside and front valances and kidneys that hid quite a bit of corrosion behind nice paint.

I wouldn´t get greedy here and take full coverage of the repair cost, be glad about the fresh parts and fresh paint and consider it a little free part-resto.

Anyone want to bump into the front of my car (lightly)? I could use some fresh paint on my hood. :)

Of course, just my 2 cents...
 
All is resolved. The dealer was great. Hard to believe they are a car dealership. The car is going over to Coupe King tomorrow for full repair plus the new exhaust I originally had them doing. The sucky thing is that I wont be getting the car for 3-4 weeks. Thanks for all of your imput, it is appreciated.
