The actual wording of Tariff code 9903.01.33 that is kicking our ass.

This is where the 50% extra tariff is getting applied on W&N orders.

It’s not a question of “metal” -it’s a matter of everything they sell is a part of a passenger vehicle and therefore gets taxed at 50% plus the 2 1/2% tariff, plus the brokerage fee, plus the currency conversion, plus the shipping and plus the difference between the euro and the dollar.
 
So, this is an entirely new classification, outside Chapter 87 that has historically applied to motor vehicles (and motor vehicle parts). What a mess.
 
its double taxation. the section that UPS referenced only says metal. i'm going to go back and read all of chapter 99 and outline it like i did the other chapter.
 
Are all of the shippers charging the higher tariff or is it just UPS? I am getting ready to buy some parts from France and they offer shipping via UPS, DHL, and Fedex.
 
From what I’ve seen. It’s mainly UPS.

FedEx has been lower in my experience. But it’s limited experience since I have basically quit buying from overseas personally.
 
So, I have a fellow rebuilding a BMW air cooled motorcycle engine from 1944 for me. Goes in an old H Mod race car. Anyway, he first tried to bring the parts in via UPS, and they tried to apply these 50 percent tariffs on steel, as if it were raw steel. They had no way to even collect the tariff or pay it to the feds. The parts were sent back to Germany! So, they shipped with TNT (part of Fedex) and there was no tariff, mysteriously. The whole sh--show took about 2 months, leaving the engine builder without anything to do (and depriving him of income). Winning!
 
If you are thinking of purchasing a car abroad, unfortunately, even that 25 year exemption is over.......this below from Cars (international shippers) yesterday. Remember this is on top of the 2.5%

  • United Kingdom (UK): 10% Duty (within a quota of 100,000 vehicles)
  • Japan: 15% Duty


All rates include the standard Most-Favored-Nation (MFN) import duty of 2.5%.




Please note that the 10% UK tariff applies only within the specified quota. Imports that exceed this limit could be subject to different rates or conditions once additional guidance is issued.



Because formal customs rulings have not yet been released, interpretations of this language may vary. We’ll continue to monitor developments closely and share updates as soon as more details become available.



In the meantime, we recommend factoring these updates into your import planning to help avoid unexpected costs or delays.

Thank for sending me a copy of the invoice. I reviewed the invoice and immediately saw that UPS has applied code 9903.81.91 to all of my items. 9903.81.91 is for METAL.

Only 4 metal washers in the invoice apply to that code.

All other items are plastic, rubber, or electrical and are subject to code 8708.99.810 which are already charged in the invoice.

Happy to pay the 9.00 tariff on the steel washers. But not willing to pay Metal tariffs on my plastic tool kit, my rubber seals and electrical sensor.

Please correct your billing to reflect that the code for METAL 9903.81.91 does not apply to my plastic, rubber and electrical items. Please remove any billing for past due fees unless it correlates to the $18.04 charge for metal washers in the invoice.
The metal washers are on page 2 listed as “Washer”

I’m happy to pay the tariff on the metal washers and any late fee on that portion of the billing.
Let me know that you have corrected the billing please and I will promptly pay the
$ 9.02 tariff and a 10% late fee on that tariff.

UPS is going to lose a lot of business. They seem to have the least ability to deal with this.

And, in a normal world, Congress would develop trade legislation, with input from their constituents, but instead we have rule by decree, with rules that change overnight. Creating a total sh--show. So maddening. Killing small businesses. I am surprised that the car dealers and their trade associations haven't made more waves abut this. They have a ton of influence in DC. Every franchise that installs imported parts into cars needing repair is affected (essentially all car dealers).
 
the dealers have the car manufacturers to sort out imports, their team of lawyers apply the tariff codes and keep their exposure to a minimum. they deal with their own freight / shipping (for the most part). Scott is right, this is killing small businesses all over the place. it impacts individuals across the country (from both sides of the aisle). this will bite one party badly in the ass ... unless they do something to stop this nonsense.
 
Not trying to add to the pile, but I had recently ordered an ignition switch for my tired old Montero (510k miles!) from the UAE. The part itself was $15; shipping was $15 via FedEx. A week after delivery I got the email I was expecting from FedEx asking for the tariff money. $7.05 in fees. Not a lot of money but the breakdown was $2.55 in tariff fees and a $4.50 processing charge from FedEx for basically paying the $2.55 for me when the part came into the country. What a load of BS!
 
that is a lower percentage that UPS is charging - $83 brokerage fee on a 180 dollar order, plus 93 tariff plus 49 euro shipping.
 
I'm talking with Walloth every day sharing the UPS mess. Can you imagine their predicament?
 
i'm doing everything possible to not order from W+N for the time being. it was cheaper to buy from getbmwparts, even if i'm paying more for the part ... shipping is cheaper and no additional tariff. there is the problem that BMW NA doesn't import everything we need.
