i think you are right Rob - e12 / early e24 column top ... i just tried to put them together and they didn't seem to work. i don't know when the 'accordian' approach started. but obviously my upper piece is not e9. i just checked the spare lower cover and it fits this piece ... but it is longer than my other lower cover. perhaps this piece is e12 or e24

so i went onto realoem - and copied the image that is in the orange books - you will see that item #2 does not have the tube - and its for up to 10/73 - this is a euro spec, not a US spec - items 3 + 4 are for RHD cars

I know what you mean, but actually the tubing doesn't limit proper angle of the shaft that goes into power steering in that setup, because the adjusting movement is only telescopic back/forward (one shaft go inside the other), not up&down.
Couple years ago when i was searching for missing parts for my adjustable steering column - while looking on tons of internet photos i noticed that E9 had two versions for adjustable steering column main part mounts (1.closed tube 2. cutted) and one does not exclude other, because rest of these two parts was exactly the same.
Orange book is not 100% your friend, i also have genuine one & use it only as initial targeting.

About two years ago i purchased E3 adjustable steering column mount part with tubing & it is/was slightly different if compare to E9 mount. At first they looked almost the same, but then i've put them side to side with each other.
Differences:
1. E3 is ca.1-2cm shorter than E9 on inside part.
2. E3 have different mounts where steering column is mounted to the dash metal body part, the mount of telescopic part is also in slightly different place, due E3 have different shape of dashboard.

So description of ebay auction is only partially right - set is from automatic geabox E3.
I marked parts from E3 on photo below, rest of the parts is interchangeable with E9.

On below photo you can see both E9 steering columns - adjustable vs. non-adjustable
you can see that dashboard mounting holes (spacing&location) & length is the same.
